The Texas Higher Education Coordinating Board sets the rules and requirements around who qualifies as a Texas resident for the purposes of in-state tuition. Texas Administrative Code Title 19 Part 1 Chapter 21 Subchapter B lays out these rules and requirements.

If you did not graduate from a Texas high school, you must establish residency via domicile. This is an option available for US Citizens, Permanent Residents, and some non-citizens who meet certain requirements.

To establish domicile, in addition to living in the state for 12 consecutive months, you or your parent (if you will be claimed as a dependent) must in this time period do one of the following: (i) be gainfully employed in Texas (student jobs do not qualify), (ii) own residential real property in Texas, (iii) be legally married to someone who has established domicile in Texas, or (iv) own and operate a business in the state.
